On July 1, 2019, the US state of Vermont’s revised reporting rules for chemicals of high concern to children (CHCC) came into effect. These changes follow the signing into law, on June 19, of bill S.55, which related to both ‘Toxics Use Reduction and Reporting’ and ‘Chemicals of High Concern to Children’.

The changes include:

  • Amending the standard for adding a chemical by rule to the CHCC list
  • Requiring reporting to include the brand name, product model, and if available, the universal product code (UPC code)
  • Altering the reporting date. Next is August 31, 2020 and then yearly, not biennially
  • Directing the Commissioner of Health to adopt by rule the process and procedure for reporting a children’s product that is introduced for sale between the required dates for reporting – this rule must be adopted by January 1, 2020

The US state of Vermont signed into law S.238, codified as V.S.A. Title 18: Chapter 38A ‘Chemicals of High Concern to Children’, in June 2014. It requires manufacturers of children’s product, or the trade association representing a manufacturer, to report the presence of CHCCs to the Department of Health (DOH). The DOH also must publish ‘Rules’ for implementing this Act.

The Act requires reporting if the CHCC is in an accessible component of a children’s product, and is:

  • Intentionally added and is greater than the practical quantification limit (PQL), or
  • A contaminant that is equal to or greater than 100 ppm
