The governor of the US state of Colorado has signed into law measures to regulate perfluoroalkyl and polyfluoroalkyl substances (PFAS chemicals) in firefighting foams and firefighting personal protective equipment (FPPE).

The bill, HB19-1279, was signed into law on June 3, 2019. It contains several important provisions, including:

  • Requiring manufacturers and/or sellers of FPPE to disclose whether the products contain intentionally added PFAS chemicals and the reason for the addition
  • Expanding the power of the Colorado Department of Public Health and Environment (CDPHE) to allow it to request certificates of compliance (CoCs) from manufacturers of Class B firefighting foam or FPPE

The requirements relating to FPPE become effective on August 2, 2019. The prohibition on PFAS chemicals in Class B firefighting foams comes into effect on August 2, 2021.
