Ukraine Further Aligns Toy Safety Rules with EU

SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that Ukraine has revised its toy safety technical regulations to strengthen the chemical requirements.

On May 14, 2022, Ukraine issued Cabinet of Ministers of Ukraine Resolution No. 557 of May 7, 2022. This revises Annex 2 of its Technical Regulations on the Safety of Toys, issued in 2018. These Technical Regulations are similar to European Union (EU) Directive 2009/48/EC, the so-called Toy Safety Directive (TSD), and have been updated several times to maintain alignment.

The latest amendment contains several important provisions, including:

  • Expanding the list of allergenic fragrances in Table 1 to paragraph 23 of Annex 2 from 55 to 58 with the inclusion of:
    1. Atranol
    2. Chloroatranol
    3. Methyl heptine carbonate
  • Revising the number of allergenic fragrances in Table 2 to paragraph 23 of Annex 2 from 11 to 71 by adding 61 entries and deleting methyl heptine carbonate
  • Restricting aniline in toys that are intended for children under 36 months, or in other toys intended to be placed in the mouth:
    1. Textile and leather materials (after reductive cleavage): no more than 30 mg/kg
    2. Finger paints (after reductive cleavage): no more than 30 mg/kg
    3. Finger paints (as free aniline): no more than 10 mg/kg

The allergenic fragrance requirements mirror the EU requirements in Directives (EU) 2020/2088 and (EU) 2020/2089 that amend the TSD.

The new law will enter into force, and the allergenic fragrance requirements come into effect, on November 14, 2022. The provision relating to aniline will become effective on December 5, 2022.
