  7. Orthoboric
    acid, sodium salt

These substances have a variety of uses, including acting as a solvent
when synthesizing chemicals, as a fragrance ingredient in cosmetics, as a flame
retardant and as a biocide. To see a complete summary of their uses, read SGS’s
original
SafeGuard 091/21.

Under Article 33 of Registration, Evaluation, Authorization and Restriction of Chemicals
(REACH), manufacturers and importers operating the European Union (EU) and
European Economic Area (EEA) are required to provide information that allows
safe use when an SVHC’s concentration within a product exceeds 0.1% (w/w). This
should be done upon supply or within 45 days when requested by a consumer. Also,
they must also notify the ECHA if an article contains an SVHC in a
concentration above 0.1% in a quantity above one tonne per year (Article 7).

These obligations come into
effect six months after an SVHC has been added to the Candidate List, meaning the
notification deadline on these eight substances is January 8, 2022.

Stakeholders should also be
aware that, a
s of January 5, 2021, EU producers, importers,
assemblers and distributers of articles containing above 0.1% w/w of an SVHC on
the Candidate List must also submit a notification to the Substances of Concern In articles as such or in complex objects (Products) (SCIP) database under the Waste Framework Directive
(WFD).
