Turkey has updated its Toy Safety Regulation (Oyuncak Güvenliği
Yönetmeliği (OGY)) to strengthen various chemical provisions and further its
alignment with Directive 2009/48/EC, the so-called European Toy Safety
Directive (TSD).
Regulation Number 30988 was published on December 24, 2019.
It contains several important changes to the OGY, including:
– Strengthening
the migration limits for:
- Chromium (VI) in Category III toy materials – from 0.2 to 0.053 mg/kg
- Lead in all three categories of toy materials:
- Category I – from 13.5 to 2.0 mg/kg
- Category II – from 3.4 to 0.5 mg/kg
- Category III – from 160 to 23 mg/kg
- Bisphenol A (BPA) in toys intended for children under 36 months or other toys intended to be placed in the mouth: ≤ 0.04 mg/kg
– Addition of phenol migration (≤ 5 mg/L from polymeric materials) and phenol content (≤ 10 mg/kg as a preservative), with the same scope of toys as for BPA (above)
– Clarification that ‘aquatic toys’ are ‘water-based toys’ and therefore include hobby paints, finger paints, window/glass paints, glues and soap bubbles
To clarify the different toy material
categories:
- Category I toy materials are defined as dry, brittle, powder-like or pliable and include chalk, crayons, plaster of Paris and bouncing putties
- Category II toy materials are defined as liquid or sticky and include bubble solutions, finger paints, liquid adhesives, poster paints and slimes
- Category III toy materials are defined as scraped-off. These include ceramics, glasses, metals, textiles, woods, elastomers, surface coating materials, bone, leather
and natural sponges
The OGY was originally introduced in October
2016, under Number 29847 in the
Resmi Gazete. It has since been revised several times to include various
provisions in the TSD.
The latest revision has two effective
dates. The provisions surrounding chromium (VI), lead, BPA and phenol will come
into effect on December 25, 2020, while the other provisions came into
effective on December 24, 2019.
Stakeholders are advised to check their
products comply with the latest requirements under the OGY.
