New Californian Right-to-Know Rules for Cosmetics Manufacturers

On September 30, 2020, the US state of California signed into law a
right-to-know act that requires cosmetics manufacturers to disclose a specific
list of chemicals used in fragrances and flavors.

SB-312 Cosmetic Fragrance and Flavor Ingredient Right to Know Act of
2020 requires manufacturers who distribute cosmetic products within the state
of California to disclose a specific list of chemicals used in fragrances and
flavors to the state’s Division of Environmental and Occupational Disease
Control (part of the Department of Public Health).

The information they disclose must include:

  • A list of
    every fragrance and/or flavor chemical that is included on a designated
    list, as defined in paragraph (2) of subdivision (a), which is present in
    the cosmetic product
  • A list of each
    fragrance allergen under Annex III of (EC) 1223/2009 Cosmetic Regulation
    in EU, and whether it is at a concentration at or above 0.01% (100ppm) or
    0.001% (10ppm) in rinse-off products and leave-on products, respectively
  • Whether the
    product is for professional use or retail
  • Chemical
    Abstracts Service (CAS) number for each ingredient or allergen that
    requires disclosure
  • Universal
    product code (UPC) of the cosmetic product

The aim of the act is to improve the information available to consumers
and salon workers so they can make more informed purchasing decisions. This is
intended to help reduce the risk to public health of exposure to harmful
chemicals. Manufacturers are not required to disclose the percentage by weight
of the concerned ingredients in order to protect trade secrets.

The requirements of the act come into force from January 1, 2022, after
which the Division of Environmental and Occupational Disease Control will also
post onto a database:

  • A list of
    fragrance and/or flavor ingredients that are included on the designated
    list
  • Health
    hazards associated with these fragrance and/or flavor ingredients
