The Netherlands Amends Requirements for Food Contact Materials and Articles

SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that The Netherlands has strengthened its requirements for food contact materials and articles (FCM).

The amendment – Regulation of the Minister of Health, Welfare and Sport of April 26, 2022 – to the Commodities Act on packaging and consumer articles was published in April 2022. It contains multiple provisions and affects products that come into contact with food.

Changes include:

  • Revisions to positive lists of substances for plastics, rubber and coatings
  • Restrictions on total lead in metal coatings strengthened
  • New requirements for glass and glass ceramics
  • Changes to rules for dyes and pigments

To help manufacturers and suppliers operating in The Netherlands, SGS has published SafeGuardS 092.22, which contains an overview of all the changes brought in by the amendment.

SGS’s expert has also highlighted the fact that the relatively high specific migration limit (SML) for lead remains at no more than 0.1 mg/kg in food contact glass and glass ceramics (Chapter V). This is at a time when the European Commission is working on legislation that will also include a SML for lead in these types of material.

The new requirements came into effective on July 1, 2022. The amendment allows for food contact materials and articles that comply with the Commodities Act as it reads on June 30, 2022, and were placed on the market before January 1, 2023, to remain on the market until stocks are exhausted.

This does not apply to paper and paperboard coatings containing specified per- and polyfluoroalkyl substances (PFAS). Such coatings are not currently found on the Dutch market and should not be accepted during the transitional period.
