Minnesota Bans PFAS in Food Packaging

The
US state of Minnesota has banned intentionally added perfluoroalkyl and
polyfluoroalkyl substances (PFAS) from food packaging.

Minnesota
becomes the latest US jurisdiction to regulate PFAS in food contact materials
and articles, joining Connecticut, Maine, New York, San Francisco, Vermont and
Washington.

SF
20 was signed into law by the governor in June 2021, amending the state’s
Statutes and adding the new Section 325F.075 ‘Food Packaging; PFAS’.

The
law defines PFAS as any substance in a family of fluorinated organic chemicals
containing at least one fully carbon atom.

The
prohibition applies to food packaging, defined in the law as a container
applied to or providing a means to market, protect, handle, deliver, serve,
contain or store a food or beverage. This includes:

  • Unit
    packages, intermediate packages and shipping containers
  • Unsealed
    receptables, including, but not limited to, bags, bowls, carrying cases,
    crates, cups, pails, plates, rigid foil and other trays, tubs, as well as
    wrappers and wrapping films
  • Individual
    assembled parts of a food package, such as any interior or exterior blocking,
    bracing, cushioning, weatherproofing, exterior strapping, coatings, closures,
    inks, and labels

This
ban will come into effect on January 1, 2024.
