India Introduces New Toy Regulation

India has published a new toy regulation under
Extraordinary in its Gazette. The Order, Toys (Quality Control) Order, 2020,
covers the regulation of toys and/or materials used for the purposes of play by
children under fourteen years of age. It will also include other toys notified
by Central Government.

The Order requires toys to conform to the latest Indian
Standard (IS), including
any amendments and as notified by the Bureau of Indian Standards. It also requires
toys to bear the Standard Mark under a license from the Bureau, as per Scheme-I
of Schedule-II of BIS (Conformity Assessment) Regulations, 2018. Finally, it
directs the Bureau to be the certifying and enforcement authority.

Toy products must conform to a
set list of standards. The primary ones are:

  • Mechanical
    and Physical Properties: IS 9873 (Part 1): 2019
  • Flammability: IS 9873 (Part 2): 2017
  • Migration of Certain Elements: IS 9873 (Part 3): 2017
  • Swings, Slides & Similar Activity Toys for Indoor/Outdoor Family Domestic Use: IS 9873 (Part 4): 2017
  • Finger Paints: IS 9873 (Part 7): 2017
  • Certain Phthalate Esters in Toys and Children’s Products: IS 9873 (Part 9): 2017
  • Safety of Electric Toys: IS 15644:2006, reaffirmed year 2016

This order was published in
the Gazette on February 26, 2020. It will come into effect on September 1,
2020.

Stakeholders should remember that India
updated it import policy in December 2019. It now requires the sending of
randomly selected toy samples from each consignment to an NABL accredited
laboratory for testing to determine customs clearance. To learn more, see our
