Health Canada Proposes Amendments to Carriage and Stroller Regulations

Health
Canada is consulting stakeholders over proposed amendments to its regulation
covering baby carriages and strollers – SOR/2016-167.

The
proposed changes are designed to strengthen health and safety, more closely
align Canadian regulations with trading partners, and address stakeholder
identified nuisances.

They
include:

Replacing
the mechanical requirements with one of the following (incorporated by
ambulatory reference):

  • Compliance
    to mechanical requirements in ASTM F833-19
  • Compliance
    with either:

            • Mechanical
              requirements in ASTM F833-19
            • Mechanical
              requirements in ISO 31110:2020 plus entrapment requirements in ASTM F833-19
              sections 6.8 and 6.10

Removing
the reference to the Toys Regulation in the surface coating materials
requirements and adding these directly into the regulation:

  • Sticker,
    film or other similar material that can be removed, or a surface coating
    material, that is applied to an accessible part of a carriage or stroller must
    not contain any of the following:

        • More
          than 90 mg/kg total lead
        • Any
          compound of antimony, arsenic, cadmium, selenium or barium if more than 1000
          mg/kg of the compound migrates from the material
        • More
          than 10 mg/kg total mercury

Testing
must be performed in accordance with a method that conforms to good laboratory
practices.

Adding
into the regulations:

  • Toxicological
    requirements set out in sections 22 and 25 of the Toys Regulation
  • Vinyl
    parts of a carriage or stroller must comply with the Phthalates Regulation

Finally,
the proposed amendments align information and warning requirements with ASTM
F833-19 or ISO 31110:20. At the same time, they maintain the requirement that
this information must be conveyed in English and French.

Stakeholders
have until June 17, 2021, to submit their comments to Health Canada.
