EU Publishes Draft Revision to CLP Regulation on Substances and Mixtures

The European Union (EU) has published a
draft regulation that, if accepted, will revise Regulation (EC) 1272/2008 on
Classification, Labeling and Packaging of Substances and Mixtures (CLP
Regulation).

The draft legislation has several
important changes, including:

  • 22 entries
    added to Table 3 in Part 3 of Annex VI – List of Harmonized Classification and
    Labeling of Hazardous Substances (Table 3)
  • 41 entries
    replaced in Table 3 – some delete the specific concentration limit (SCL)
    information for several boron-containing compounds, including the penta- and
    deca-hydrates of disodium tetraborate (borax)
  • 1 entry
    deleted from Table 3 – tetrakis(2,6-dimethylphenyl)-m-phenylene biphosphate
    (CAS 139189-30-3)

The draft regulation was attached to World
Trade Organization (WTO) document 20-5008 on July 21, 2020. According to this
notification, the changes will be:

  • Adopted in
    Q4 of 2020
  • Entering
    into force 20 days after it is published in the Official Journal of the EU
    (OJEU)
  • Effective
    18 months after the date of entry into force for the new harmonized
    classification, labeling and packaging provisions (potentially this is
    mid-2022)

The draft regulation states that substances
and mixtures may be classified, labeled and packaged in accordance with the
amendment from the date of entry into force.
