The European Union (EU) has published
Directive (EU) 2021/903 to restrict aniline in specific toy materials falling
under Appendix C to Annex II of Directive 2009/48/EC, the so-called European
Toy Safety Directive (TSD).
According to the EU CLP Regulation, aniline
is a substance that is carcinogenic category 2 and mutagenic category 2. It is
found in textiles and finger paints after reductive cleavage. It is possible
the substance may also be found as free aniline in finger paints and in leather
after reductive cleavage.
The requirements for aniline brought
in by Directive (EU) 2021/903 are:
- Textiles and leather (after reductive cleavage): no more than 30 mg/kg
- Finger paints (after reductive cleavage): no more than 30 mg/kg
- Finger paints (free aniline): no more than 10 mg/kg

Appendix C to Annex II of the TSD
relates to toys for children under 36 months and other toys intended to be
placed in the mouth. Following the addition of aniline, the total number of
regulated substances is now twelve:
- Tris (2-chloroethyl)
phosphate - Tris (2-chloro-1-methylethyl) phosphate
- Tris [2-chloro-1-(chloromethyl)ethyl] phosphate
- Bisphenol A (BPA)
- Formamide
- 1,2-Benzisothiazol- 3(2H)-one
- 5-Chloro-2-methylisothiazolin-3(2H)-one
- 2-Methylisothiazolin-3(2H)-one
- 3 to 1 mixture of 5-chloro-2-methyl-4-isothiazolin-3-one and
2-methyl-2H-isothiazol-3-one - Phenol
- Formaldehyde
- Aniline
Directive (EU) 2021/903 was published
on June 4, 2021. Member States have until December 4, 2022, to adopt and
publish the updated laws, regulations and administrative provision. Compliance
must begin on December 5, 2022.
