COVID-19 Causes Brazil to Defer New Food Contact Plastics and Polymeric Coatings Regulations

The Brazilian National Health Surveillance Agency (ANVISA) has
delayed the implementation of new regulations on additives in food contact
plastics and polymeric coatings.

Transposed from Mercosur GMC Resolution No. 39/2019 and published
by ANVISA in December 2019, Resolution of the Collegiate Board of Directors No.
326 of December 3, 2019 (RDC 326/2019) will establish, among other things, the
following provisions:

  • A positive list of more than 1,000 substances
  • Restrictions for heavy metals, phthalates and primary aromatic amines,
  • Limitations on the use of certain solvents

The initial effective date for RDC 326/2019 was June 1, 2020,
however, due to the COVID-19 pandemic, ANVISA has decided to push back the
effective date until June 3, 2021. This was published on May 28, 2020, in Resolution
of the Collegiate Board of Directors No. 391 of May 26, 2020 (RDC 391/2020).
